RULES & REGULATIONS
THIS CONTEST IS OPEN TO ALL CANADIAN RESIDENTS 18 YEARS OF AGE OR OLDER AND IS GOVERNED BY CANADIAN LAWS. NO PURCHASE NECESSARY.

1. CONTEST PERIOD
The Nutella Spring Contest (the “Contest”) is held by Ferrero Canada (the “Sponsor”). It starts at 3:00:01 p.m. (ET) on February 2nd, 2015, and ends at 5:00:01 p.m. (ET) on June 30, 2015 (the “Contest Period”).

2. ELIGIBILITY
To enter and be eligible to win, an entrant must be a resident of Canada who is 18 years of age or older. Employees and representatives (and those with whom such persons are domiciled) of the Sponsor, its parent companies, subsidiaries, affiliates, prize suppliers, advertising and promotion agencies, and participating stores (collectively the “Contest Parties”) are not eligible.

3. HOW TO ENTER
No purchase necessary.
A. SPIFE Instant Win PIN Entry.
To enter the Contest with a PIN go to addjoy.nutella.ca (the “Website”), (i) Enter the unique PIN code in the corresponding field; (ii) agree to the terms and conditions of these Official Contest Rules by checking the corresponding box; and (iii) click on “Submit”. For each unique valid PIN you submit you will be eligible for a chance to win a Nutella SPIFE prize. Those selected as SPIFE instant prize winners will be notified with a message on screen. Those selected as eligible winners must complete a form including name, age, mailing address and correctly answer a skill-testing question in order to claim the SPIFE prize. Each PIN code can only be used once.
PIN codes can be obtained in one of the following ways:
• By purchasing specially marked 375 gram, 725 gram, or 2x725 gram jars of Nutella with contest PIN. PIN codes are located on the inside of cap-stickers of specially-marked jars sold in Canada. There will be a total of approximately 3,300,000 PIN codes available at the onset of this Contest, distributed throughout Canada in specially-marked 375 gram, 725 gram and 2 X 725 gram jars. In the specially marked 2 X 725 gram jar packs there is one PIN per 725 gram jar.
• By sending a no-purchase PIN code request. To obtain one (1) PIN code without purchase, legibly handwrite an original letter of at least fifty (50) words explaining why you would like to win a Nutella SPIFE, along with your last name, first name, complete address including postal code, valid e-mail address, and age. Sign and send your letter in an envelope with sufficient postage to: “Nutella Spring Contest”, Suite 308, 675 King Street West, Toronto, Ontario, M5V 1M9, no later than June 15th, 2015.
The Releasees (see section 8) take no responsibility for any lost, stolen, delayed, illegible, damaged, misdirected, late or destroyed mail-in no-purchase PIN requests.
B. Instant Win Secondary Prize Entries
During the Contest Period, you may also enter on the Website via the “Spoon it or Spread it” game for a chance to win secondary instant win prizes.
Click on the Spoon It or Spread it button on the Website landing page. Register for the game by connecting with Facebook and accepting the rules and regulations. You will then be shown a series of food items and asked whether you would spoon or spread Nutella on. For each question you respond to, you will be eligible for a chance to win a Secondary Prize. Secondary Prizes will be awarded at random during the Contest Period and those randomly selected to claim one will be notified on screen on the Website. A Facebook account, which is free, is required to be eligible for Secondary Instant Win Prizes.
Limits. Entrants must respect the following limits otherwise they may be disqualified:
• The use of only one (1) Facebook account or e-mail address when an entrant has more than one.
• Entering your code from product packaging. Each PIN code can only be used once.
• No-purchase PIN code requests. One (1) no-purchase PIN code request per household.

4. INSTANT WIN PRIZES
There are Twenty thousand (20,000) SPIFE Instant Win Prizes and One thousand five hundred and fifteen (1,515) secondary instant win prizes available to be won during the Contest Period.
The SPIFE is a custom Nutella utensil (one end has a spoon, one end has a knife) and is not sold at retail. Secondary Instant Win Prizes consist of: One thousand (1000) t-shirts with an ARV of $10, Five hundred (500) sticky note pads with and ARV of $3, Five (5) mixers with an ARV of $349, Five (5) waffle makers with an ARV of $89, Five (5) panini presses with an ARV of $130.
Instant Win Prize winners are selected at random and will be shown a message on screen declaring their eligibility to claim the prize following their entry. Users must complete an Instant Win Prize claim form with full mailing address and correctly answer a mathematical skill testing question in order to claim the prize.
Odds of winning a SPIFE Prize. The odds of an entrant being selected for a SPIFE Prize depend on the number of eligible entries received via unique PIN entry contest mechanic. A minimum of one (1) SPIFE Instant Win prize will be awarded each week during the Contest Period.
SPIFE Prize Limit. There is a limit of one (1) SPIFE Instant Win Prize per person and per household for the Contest Period.
Odds of winning a Secondary Instant Win Prize. The odds of an entrant being selected for a Secondary Instant Win Prize depend on the number of eligible Secondary Instant Win interactions via the Spoon it or Spread it game each day during the Contest Period. A minimum of one (1) Secondary Instant Win prize will be awarded each week during the Contest Period.
Secondary Prize Limit. There is a limit of one (1) of each Secondary Instant Win Prize type per person and per household for the Contest Period.

5. LICENSE:
Users can also upload their recipes on the Website. By accepting the contest rules and regulations consumer: (i) grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use his/her submitted content on the website, in whole or in part, for advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to his/her in favour of the Sponsor; and (iii) agrees to release and hold harmless the Contest Parties and each of their respective agents, employees, directors, successors, and assigns from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action that relate in any way to the submission (or any component thereof). For greater certainty, each entrant understands and agrees that his/her content submission may be reposted on the Sponsor’s websites at www.nutella.ca and addjoy.nutella.ca.

6. LIMITATIONS OF LIABILITY
Without limiting the release provided in section 5 above, and for greater certainty, the Releasees will not be liable for: a) any incomplete or inaccurate information, whether caused by Website users or by any equipment or programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of entries; b) the theft, loss, destruction or unauthorized access to, or alteration of entries or the Contest Website; c) any problems with, or technical malfunctions of, telephone networks or lines, computer online systems, servers or providers, computer equipment, software, viruses or bugs; d) any failure of any e-mail or entry to be received by or from the Sponsor for any reason including but not limited to traffic congestion on the Internet or on any website or combination thereof; e) damage to an entrant’s or other person’s system occasioned by participation or uploading or downloading of materials in this Contest; any use of the entrant’s personal information as set out in section 9. Furthermore, persons who enter or try to enter this Contest release the Releasees from any liability for damage these said persons may incur as a result of their entry or their attempt to enter the Contest.

7. PERSONAL INFORMATION
By entering this Contest, entrants consent to the collection, use and disclosure of their personal information for the purposes of administering the Contest and in accordance with the Sponsor’s privacy policy available at: www.nutella.ca. Notwithstanding the Privacy Policy, by entering the contest you agree that Ferrero may disclose your information to third parties for the purpose of contest administration, prizing administration and for the purpose of contacting you to conduct market research. By selecting the opt-in to agree to receive promotional information and be contacted in the future you agree that Ferrero may disclose your information to third parties for the purpose of contacting you for future promotional opportunities and, or brand offers. In connection with administering the Contest, personal information may be processed and stored in one or more jurisdictions outside Canada (which may include the United States), and may be subject to access by regulatory authorities in those jurisdictions. By submitting a recipe on the website or entering the contest, users consent to the use and disclosure to the public of their submitted content, names, place of residence (city, province), voices, statements about the Contest, and/or photographs or other likenesses for publicity purposes in connection with the Contest in any media or formats including, but not limited to, print, broadcast or the Internet, without further notice, permission or compensation. Personal information will not otherwise be used or disclosed without consent.

8. MISCELLANEOUS
All decisions of the Sponsor, or any Contest judging organization, are final and binding in all matters relating to this Contest and on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries, subject to a ruling by the Régie des alcools, des courses et des jeux du Québec on any issue under its jurisdiction. The Sponsor and other Releasees will not be responsible for illegible, incomplete, lost, misdirected, errors, failures or late entries which will be void. Contest is subject to all applicable federal, provincial and municipal laws. In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A selected entrant may be required to provide the Sponsor with proof that he/she is the authorized account holder of the e-mail address associated with the selected entry.

9. TAMPERING OR DISRUPTION
The Sponsor reserves the right, at its sole and absolute discretion, to disqualify, from this Contest and any future Contest or other promotion, conducted by the Sponsor, any individual that they find or believe to be not in compliance with these Official Contest Rules, to be tampering with the entry process or the operation of the Contest or Website; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Use of any automated system to enter or otherwise participate in this Contest is prohibited and will subject the entrant or purported entrant and all associated entries to disqualification at the sole and absolute discretion of the Sponsor. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

10. VERIFICATION
Entries, PIN codes, no purchase PIN codes, PIN code requests, and claim forms are subject to verification by the Sponsor. Any entry, PIN code, no purchase PIN code, PIN code request, or claim form which is incomplete, illegible, mutilated, fraudulent, registered or submitted late, bearing an invalid e-mail address, not bearing the correct answer to the mathematical skill-testing question or otherwise noncompliant shall be rejected and will not entitle the entrant to an entry or to a Prize, as the case may be.

11. QUEBEC RESIDENTS
For Quebec residents: Any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Régie des alcools, des courses et des jeux (the “Régie”) for a ruling. Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

12. RIGHT TO TERMINATE OR AMEND
The Sponsor reserves the right, subject to the approval of the Régie if applicable, to terminate, suspend or amend this Contest and/or amend these Official Contest Rules, in whole or in part, at any time and without prior notice if any factor interferes with its proper conduct as contemplated by these Official Contest Rules. In the event of Contest termination, any remaining prizes still to be won will, at the Sponsor’s sole discretion, be deemed expired and void and will be ineligible for Contest play, and, without limiting any other provision of these Official Contest Rules, the Releasees will not have any further liability with respect thereto.

13. INTELLECTUAL PROPERTY
All intellectual property used by the Sponsor in connection with the promotion and/or administration of the Contest, including, without limitation, all trade-marks, trade names, copyrights, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned (or licensed, as the case may be) by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any such intellectual property without the express written consent of its owner is strictly prohibited.

14. LIABILITY LIMIT: PRIZE SUPPLIER
Any entrant selected for a prize acknowledges that upon awarding of the prize, any and all obligations related to any element of the prize become the responsibility of the provider(s) of services and goods related thereto.

15. PRIZE LIMIT
In no event shall the Sponsor be required to award more prizes than indicated in these Official Contest Rules or to award a prize otherwise than in compliance with these Official Contest Rules.

16. DEFECTIVE PIN CODES
The Sponsor is not liable for improper handling of PIN codes which prevents the PIN codes from having the essential characteristics set out in these Official Contest Rules and prevents entry in the Contest. In no event will the Sponsor issue a replacement for a lost or stolen PIN code. In the event a PIN code is subject to a manufacturer’s defect and does not allow an entrant to enter the Contest, the Sponsor’s liability will be limited to the replacement of the PIN code as follows: send the defective PIN code along with your last name, first name, mailing address including postal code, e-mail address, and age in an envelope with sufficient postage to: “Nutella Spring Contest”, Suite 308, 675 King Street West, Toronto, Ontario, M5V 1M9, no later than June 30th, 2015, postmark bearing proof thereof, otherwise it will be null and void. Following the validation the defective PIN code, the Sponsor will send you a new PIN code, if time permits, via the e-mail you provided.

17. PROPERTY
No-purchase PIN code requests and all materials submitted by consumers on the Website are the property of the Sponsor. No purchase PIN code requests shall not in any case be returned to entrants.

18. UNENFORCEABILITY
If a section of the Official Contest Rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law.

19. LANGUAGE
In case of any discrepancy between the French and English versions of these Official Contest Rules, the English version shall prevail.

20. THIRD PARTY EXONERATION
The Contest is in no way sponsored, endorsed or administered by, or associated with Facebook. You understand that you are providing your information to the Sponsor and not to Facebook. The information you provide will only be used for the administration of this Contest and in accordance with the Sponsor’s privacy policy. Facebook is completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not Facebook.
